Boxer Pacquiao facing class action suit after "Fight of the Century"

On May 2nd, boxer Manny Pacquiao took on Floyd Mayweather in a much anticipated and long-time-coming boxing matchup. The matchup was one of the richest boxing fights in history and Pacquiao was set to receive roughly forty percent of the $300 million that the fight was expected to generate in revenue. Pacquiao did his best--but lost to the still undefeated champion in a 12-round decision. After the fight, he revealed that he had been suffering from a torn rotator cuff.

He is now being sued by two residents from Nevada alleging that viewers and gamblers were cheated because promotors concealed Pacquiao's shoulder injury. The $5 million class action suit was filed in a Las Vegas U.S. District Court and names Pacquiao, his promotion company Top Rank Inc. and president Todd DuBoef, adviser Michael Koncz and promoter Bob Arum as defendants.

The Nevada residents are suing on behalf of ticket and pay-per-view buyers and betters who they allege were cheated because promotors concealed Pacquiao's injury. The complaint alleges that Pacquiao and Top Rank Inc., one of the promoters of the "Fight of the Century," had a duty to disclose the injury to the Nevada State Athletic Commission and failed to do so until shortly before the start of the match.

Top Rank said in a statement posted on its website Monday that Pacquiao's advisers had notified the U.S. Anti-Doping Agency of the injury and received approval for him to use Toradol, a non-steroid, anti-inflammatory as treatment. The Nevada Commission stopped the treatment shortly before the fight because, according to Top Rank's statement, it was unaware of the injury. Pacquiao went ahead with the fight even though his shoulder wasn't "perfect," according to the promoter's statement.

Attorney Dan Petrocelli, the lawyer for Top Rank stated that "the case is frivolous and we expect it to be dismissed in due course."

Pacquiao has shoulder surgery scheduled for this week.

The case is Vanel v. Pacquiao, 15-00842, U.S. District Court, District of Nevada (Las Vegas).
