Bill Cosby is Asking Judge to Dismiss Defamation Suit

Three women have accused well-known comedian, Bill Cosby of decades-old sexual offenses. The three women have filed suit in a U.S. District Court in Massachusettes and seek an unspecified amount of money for compensatory and punitive damages. The women have all stepped forward recently and allege that Cosby's representatives branded them as liars while Cosby attempted to defend his innocence in the sexual suit.

Cosby's attorneys say their client denies all of the allegations of sexual misconduct. Moreover, Cosby was merely acting in self-defense while his character was under attack. In their papers, the attorneys for Cosby state:

"The law does not require that one stand idly by while he is

publicly attacked. Instead, the law entitles an individual who

is accused of serious wrongdoing to rebut the allegations

without facing defamation claims."

The attorney for the three accusers, Joseph Cammarata, disagree with Cosby's position and believe that the law provides that a public statement must be truthful when it is about an individual. He stated that, "[w]e look forward to an opportunity to have the truth tried by a jury who can ultimately determine which of the parties was being truthful."

At least 15 women have stepped forward in recent years to level various assault accusations:

  • Tamara Green, a California lawyer, alleges that Cosby drugged and sexually assaulted her in her apartment in the early 1970s.

  • Therese Serignese alleges that Cosby drugged and raped her in a dressing room after a show in Las Vegas around 1976.

  • Linda Traitz alleges Cosby tried to drug her and then groped her on a Southern California beach in about 1970.

The women are attacking some of the statements, such as a November 2014 statement by Cosby's attorney, Martin Singer. The statement references Traitz's "extensive" criminal record, which includes larceny, fraud and drug possession charges. He stated "consider the source" and attached copies of her criminal and prison records with the statement.

Lawyers for the three accusers have until March 20, 2015 to file a reply to Cosby's motion to dismiss the suit.
